1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and fovoxo OÜ ("we", "us", "our"), an Estonian company (Registry code: 16112801; Address: Harju maakond, Tallinn, Lasnamäe linnaosa, Sepapaja tn 6, 15551, Estonia) regarding your use of the Oave mobile application ("Oave", "the app").
By downloading, installing, or using Oave, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not download, install, or use the application.
2. Description of the Service
Oave is a wellness and acoustic personalization application that provides customizable sound and relaxation tools. The app provides:
- Synthesized sound generators, broadband maskers, and personalized tone overlays.
- Curated ambient soundscapes, nature sounds, and background music.
- A sound-personalization and fine-tuning engine that lets you tune the sound to your own tinnitus sound profile and frequencies.
- A sleep timer, breathing and grounding exercises, local wellness check-ins, and daily logs.
3. Mandatory Medical Disclaimer
Oave is a wellness and sound masking tool. Oave is NOT a medical device, is not certified as healthcare software, and does not provide medical treatment, diagnosis, cure, or prevention of tinnitus or any other health condition.
By using the application, you explicitly acknowledge and agree that:
- Oave is not a substitute for clinical diagnosis, treatment, or advice from qualified healthcare professionals (such as ENT specialists or audiologists).
- You must never disregard professional medical advice or delay seeking evaluation due to information or tools contained within Oave.
- You use Oave and its sound engineering features entirely at your own risk. fovoxo OÜ assumes no liability for health outcomes or any perceived changes in your symptoms.
4. Hearing Safety and Appropriate Use
Oave generates audio frequencies that are controlled entirely by the user. To protect your hearing apparatus:
- Always initiate playback at a low, conservative volume and adjust upward gradually.
- Never use the app at painful, uncomfortable, or excessively high volume decibels.
- Take frequent, regular listening breaks to prevent auditory fatigue.
- Exercise high caution when using in-ear headphones (earbuds), avoiding prolonged exposure to dense sound maskers.
- Safety Warning: Do not use Oave or listen to noise maskers while driving, operating heavy machinery, or in any environment where ambient hearing is necessary for physical safety.
You are solely responsible for the volume levels you select. fovoxo OÜ is not responsible for hearing damage, acoustic trauma, or other bodily harm resulting from the use or misuse of the app.
5. Age Requirements and Eligibility
You must be at least 13 years old to use Oave. If you are under the age of 18 (or the age of majority in your jurisdiction), you represent that you have reviewed these Terms with your parent or legal guardian and have obtained their explicit consent to use the app. Oave does not knowingly target or permit use by children under 13.
6. Local Storage and Data Preservation
Oave operates on a decentralized, privacy-focused architecture. Your tinnitus profiles, audio presets, configurations, and check-in logs are stored exclusively in your device's local memory and are not backed up to external servers managed by fovoxo OÜ.
You are entirely responsible for backing up your app configurations using the local export tool (Settings → Export my data). fovoxo OÜ is not liable for any data loss resulting from device malfunction, operating system updates, app cache clearance, or uninstallation.
7. Subscriptions, Pricing, and Billing Terms
Oave offers a premium access tiers ("Premium") available via auto-renewing subscription plans (e.g., monthly and annual options).
7.1 Pricing and Fees
The specific rates, billing cycles, and promotional offers applicable to your Premium subscription are explicitly displayed within the application’s purchase screens (paywalls) and the respective app store listing prior to purchase.
- Prices are subject to local taxes, regional currency conversion rates, and storefront adjustments managed automatically by Apple and Google.
- fovoxo OÜ reserves the right to modify subscription fees or change feature availability at its sole discretion. Any price changes for existing subscribers will be communicated in advance via app store mechanisms in compliance with store policies.
7.2 Free Trial Management
Oave may offer a free trial period for specific subscription plans. If a free trial is provided, the exact duration will be specified on the in-app purchase screen.
To avoid being charged for the subsequent billing cycle, you must cancel the subscription through your app store account settings at least twenty-four (24) hours before the free trial period expires. If you do not cancel within this timeframe, the trial will automatically convert into a paid recurring subscription, and your registered payment method will be changed.
7.3 Store Processing and Auto-Renewal
All purchases, payments, and subscription renewals are processed natively through the Google Play Store (for Android) and the Apple App Store (for iOS). Your commercial billing relationship is directly with the respective app store provider, not fovoxo OÜ.
All subscriptions automatically renew for successive billing periods unless auto-renew is disabled or cancelled through your app store account settings at least 24 hours prior to the end of the current billing cycle.
7.4 Cancellations and Refunds
You can cancel your subscription at any time via your Google Play or Apple App Store subscription settings. Following cancellation, you will retain access to Premium features until the end of your current paid billing period.
Because all transactions are processed by Google or Apple, fovoxo OÜ cannot directly process or issue refunds. All refund requests are governed entirely by the consumer policies of the respective app store.
8. Intellectual Property Rights
All source code, user interfaces, visual designs, audio samples, acoustic presets, graphics, text, trademarks, and intellectual property embedded within Oave are owned exclusively by fovoxo OÜ or its licensors.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Oave on your personal mobile devices solely for your private, non-commercial wellness management. You are strictly prohibited from copying, modifying, decompiling, reverse engineering, distributing, or extracting the software components of Oave without our explicit prior written consent.
9. Acceptable Use Restrictions
You agree that you will not:
- Use Oave for any illegal, unauthorized, or fraudulent purpose.
- Interfere with, disrupt, or compromise the integrity or security of the application or its third-party service connections.
- Bypass subscription validation systems or attempt to unlock Premium layers through unauthorized modifications.
- Exploit the app's synthesized audio blocks or export raw sound materials for commercial distribution or alternative deployment outside the official Oave ecosystem.
10. Third-Party Infrastructure Services
Oave relies on specialized third-party services to ensure operational stability, subscription compliance, and proper delivery:
- Google Play Store & Apple App Store: For app hosting, security distribution, and payment processing.
- RevenueCat: For verifying, validating, and synchronizing automated subscription receipts.
These entities maintain independent legal terms and privacy policies. fovoxo OÜ is not responsible for the performance, policies, or operational uptime of these external service providers.
11. Disclaimer of Warranties
Oave is provided to you on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
To the maximum extent permitted by law, fovoxo OÜ disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the application will operate continuously, error-free, or without audio distortion. We make no guarantees that Oave will reduce your perception of tinnitus or result in measurable health improvements.
12. Limitation of Liability
To the maximum extent permitted by applicable law, fovoxo OÜ, its directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of data, psychological distress, physical injury, hearing exacerbation, or financial loss arising from your use of or inability to use the application.
In no event shall our total aggregate liability for all claims arising out of or relating to these Terms or your use of Oave exceed the total amount actually paid by you to fovoxo OÜ for the application within the twelve (12) months immediately preceding the event giving rise to the liability. If you have used the application free of charge, you acknowledge that your sole remedy is to cease using the application.
Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by the mandatory consumer protection laws of your country of residence. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our gross negligence, fraud, or intentional misconduct.
13. Indemnification
You agree to defend, indemnify, and hold harmless fovoxo OÜ and its officers from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) resulting from your breach of these Terms, your misuse of the app, or any safety or health choices you make in connection with your audio habits or medical conditions.
14. Termination of Service
You may terminate this agreement at any time by deleting Oave from all your mobile devices. fovoxo OÜ reserves the right to suspend or terminate your access to Premium or the app entirely, without prior notice, if we determine that you have violated these Terms or engaged in behavior that creates legal or operational risks for fovoxo OÜ.
15. Governing Law and Dispute Resolution
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law principles.
Any formal legal action or dispute arising under these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Estonia.
16. Modifications to Terms
We reserve the right to update or modify these Terms at any time. When material adjustments occur, we will change the "Last updated" date at the top of this document and deploy a prominent notification layout within the app interface. Your continued usage of Oave after such updates constitute binding acceptance of the modified Terms.
